Asylum, An Immigrant Visa for Qualified Applicants

Understanding the eligibility requirements for obtaining asylum status in the United States can be a difficult process to navigate alone. Seeking an asylum visa is challenging and could take many years to obtain. The first requirement for seeking asylum is that you must be present in the United States for less than a year since arrival. If you are let in, you will be sent to a “credible fear” hearing monitored by a United States Citizenship and Immigration asylum officer.  This officer does not have the power to grant asylum. However, they decide if your reasoning is a legitimate fear that qualifies enough for an immigration judge to hear your case.  If the asylum officer doesn't believe your circumstances, you will be deported. The only option you have now is to ask the immigration judge to take another look at your situation and hope for the possibility they see things differently.

If you are applying for asylum inside the U.S., you will have one year to apply from your dated entry. The first step for this application is to fill out USCIS From I-589.  This file is free to file and must contain a personal statement and be able to orally explain your circumstances if needed. In addition, it would be critical to include documents that support your claim of why you are seeking asylum. Even if you are unable to provide documentation it is essential to have a well- prepared case that describes how threatening and dangerous it would be if you could not flee your country. The next step would be a scheduled interview at the USCIS asylum office. Waiting for these interviews could take many years depending on location within the U.S.
