Obtaining a Green Card Through Marriage

Obtaining a green card through marriage is not as easy as it may seem, it is a quite complicated process that consists of various requirements and rules pertaining to the United States marriage visa process. A marriage-based green card is considered one of the most common forms of permanent residency considering the fact that the foreign spouse of the US citizen is immediately falls into the relative category. This makes the spouse eligible for a green card and permanent resident status.

  • What is a Marriage-Based Green Card?

There is specified criteria in order to qualify for the marriage-based green card, if the petitioning spouse and foreign national spouse do not meet any of the listed criteria, they do not qualify for the green card. The requirements for this specific green card are:

  1. The spouse petitioning for their foreign national spouse must either be a United States citizen or a permanent resident
  2. Any prior marriages for either spouse must have legally and officially ended
  3. The couple must be in a legal marriage
  4. The marriage must be real and not intended for the purpose of obtaining a green card

If the couple meets the marriage-based green card requirements listed above, they are then able to apply for a green card. Finally, after all the requirements have been met, the immigrant will be given an interview date. At the interview, the immigrant must bring with them their U.S. citizen spouse. This can often be very stressful, especially if the immigrant officer believes there may be fraud in the marriage. This is the officers best chance to determine if the marriage is real or false.

The green card interview is the final step in the marriage-based green card process. The location of where the interview takes place depends on where the foreign national spouse seeking a green card resides. The key goal of all interviewing officer's is to simply analyze and assess the validity and authenticity of the marriage between the petitioning spouse and foreign national spouse. The questions may consist of anything in between the couple's future plans to their history together as a couple. If the officer is effectively convinced of the validity of the marriage, they will then approve the foreign national spouse for a green card and permanent residency.
